How long will my claim take?
This depends on the type of injuries you've suffered and whether or not the other person's Insurer fights your claim. If your claim and injuries are minor/moderate and someone accepts responsibility for your accident straightaway you could get your compensation within 6-9 months. If your injuries are more serious, a settlement may take much longer. This is because, before you claim, you need to be sure you have either fully recovered or know how your injuries will affect you in the future so that we can claim for everything you've suffered.
Most claims are settled within 12-18 months.
What happens next?
We will investigate your claim and discuss the full details of your accident with you over the phone or visit you at home or in hospital. Then we write a letter to the other person's Insurer claiming compensation. The Insurer has three months to look at the claim, and then they must decide whether or not they are going to fight the claim. If they fight the claim, we will decide whether go to the Courts. We will discuss this with you and together we will decide if your claim is going to win in the Courts. If the Insurer does not fight the claim and you have recovered, we will start negotiations with them to settle your claim immediately. If you have not fully recovered we will wait until your condition has improved so that everything can be taken into account in your claim. Before we can settle your claim we need a full medical report setting out the complete picture of your injuries and how they will affect you in the future. So make sure you tell your doctor about all your symptoms and that you are making a compensation claim.
